Casino billionaire Steve Wynn\u2019s lawsuit<\/a> against celebrity civil rights lawyer Lisa Bloom is one of the more compelling defamation cases in recent memory. For a start, it hinges on whether a man who is registered blind is capable of \u201cleering.\u201d<\/p>\n

And it\u2019s full steam ahead. The case has been allowed to continue after a federal judge in Nevada denied Bloom\u2019s motion to dismiss earlier this month, court records reveal.<\/p>\n

Wynn sued Bloom in April last year over a March 22 press release in which she accused Wynn of \u201cleering\u201d at an unnamed female client.<\/p>\n

The client — formerly a dancer in the show ShowStoppers at Wynn Las Vegas\u2019 Encore Theater from late 2014 through late 2016 — alleged that whenever Wynn stopped by, she and her colleagues were told to strip to their underwear and put on heels and makeup, \u201cso as to be sexually appealing to Mr. Wynn,\u201d according to Bloom\u2019s release.<\/p>\n

Blind Justice <\/strong><\/h2>\n

The press statement was issued one day after Wynn sold his entire stake in Wynn Resorts in a bid to distance the company from the wave sexual misconduct allegations<\/a> that had surfaced against him earlier that year.<\/p>\n

Wynn has denied all allegations, but he had a very specific reason for objecting to this one: he\u2019s legally blind.<\/p>\n

Mr. Wynn never, directly or indirectly, instructed any dancers at any time to strip down to their bras and panties,\u201d asserts Wynn\u2019s lawsuit. \u201cMr. Wynn never leered at Defendants\u2019 unidentified client or any performer during the rehearsals he attended. When he was in his 20s, Mr. Wynn was diagnosed with a rare and degenerative eye disease, and he has been legally blind for almost two decades.\u201d<\/p><\/blockquote>\n

The Public Interest<\/strong><\/h2>\n

Wynn suffers from retinitis pigmentosa (RP), a genetic disorder that causes the cells in his retina to break down irreparably over time. It does not, however, cause total blindness, and whether it\u2019s possible for someone in the latter stages of RP to \u201cleer\u201d is up to the court to decide.<\/p>\n

\u201cPlaintiff\u2019s cause of action for defamation is based upon defendant\u2019s published statements,\u201d wrote the judge. \u201cThese statements relate directly to a significant issue of public interest, namely a pattern of sexual harassment against a public figure \u2014 and in the context of heavy media attention upon those allegations in the midst of the worldwide #MeToo movement.\u201d<\/p>\n

Bloom — who follows in the footsteps of her mother, Gloria Allred, also a high-profile and sometimes controversial women\u2019s rights lawyer — was unapologetic this week and apparently relishing the prospect of being sued by Steve Wynn.<\/p>\n
