Everi Holdings responded last week to a lawsuit in a Texas federal court filed nearly two months ago by Sightline Payments. The Texas-based company seeks to dismiss the case or at least get it moved to Nevada.<\/p>\n

Sightline filed the lawsuit on Sept. 30, claiming Everi\u2019s CashClub Wallet cashless gaming solution infringes on at least five of its patents. Based in Las Vegas, Sightline filed the lawsuit in the Western District of Texas US District Court.<\/p>\n

Besides Everi Holdings<\/a>, Sightline also listed Everi Payments, Everi Games Holding, and Everi Games as defendants in the case.<\/p>\n

However, in Everi\u2019s response filed last Wednesday, John Artz of Dickinson Wright PLLC said that Everi Payments, which is the only Everi litigant involved with the product in question, does not have \u201ca regular and established place of business\u201d in the jurisdiction.<\/p>\n

Only Everi Games Holding is in the jurisdiction, according to Artz\u2019s filing. But he said that the four listed entities are not \u201calter egos\u201d of each other.<\/p>\n

In addition, Artz cited federal patent and copyright law, saying that any civil action should take place where the alleged infringement took place, or where the accused company is established.<\/p>\n

\u2026this action could have been\u2014and should have been\u2014brought in the District of Nevada,\u201d<\/strong> Everi\u2019s motion stated. \u201cMoreover, all of the material physical evidence and documents are located in Nevada; the relevant party and third-party witnesses are located in Nevada; and Nevada has a localized interest in this case.\u201d<\/strong><\/p><\/blockquote>\n

Artz also noted that the jurisdiction picked has seen \u201ca significant uptick\u201d in patent lawsuits in recent years.<\/p>\n

Lawyer: Two Everi Companies Should Be Dismissed<\/h2>\n

In the same motion, Everi said that if the entire case is not dismissed, then at the least, Everi Games and Everi Games Holding should be dismissed from the lawsuit.<\/p>\n

Artz said that there is nothing that shows either of those defendants have developed, marketed, or used the cashless gaming solution.<\/p>\n

In the lawsuit, Sightline<\/a> listed the companies because it said Everi Holdings \u201cpublicly refers to\u201d itself and its subsidiaries in the collective.” Sightline noted that Everi promoted a \u201cdigital neighborhood\u201d at the Global Gaming Expo in October. That represented a complete suite of financial, consumer loyalty, and compliance products interested parties could buy as a suite.<\/p>\n

Sightline Responds<\/h2>\n

In a statement to Casino.org Monday, Sightline Chief Legal Officer Jennifer Carleton said that Everi\u2019s response did not \u201csubstantively address\u201d the lawsuit\u2019s claims.<\/p>\n

Sightline claims that Everi\u2019s CashClub Wallet uses systems that connect non-wagering accounts with gaming environments, and allow gaming systems to pull funding from those accounts. That is a solution Sightline said is similar to the platform it developed, based on technology the company\u2019s three cofounders patented.<\/p>\n<\/div>\n

When Everi announced its cashless gaming solution, Sightline said it tasked its intellectual property lawyers to review the competition\u2019s offering. That\u2019s when Sightline said the infringements were uncovered.<\/p>\n

Carleton added that Everi indicates it can\u2019t refute the claims. She also indicated that Sightline would oppose moving the case.<\/p>\n

\u201c<\/strong>Everi was quick to denounce Sightline\u2019s claims of patent infringement and commented that it would \u2018vigorously defend\u2019 against a lawsuit that Everi characterized as \u2018without merit,\u2019\u201d Carleton said. \u201cDespite these statements, Everi\u2019s motion instead suggests that its senior leadership was somehow unaware of the actions of its wholly-owned subsidiaries. We look forward to further discussing this case in the Western District of Texas where there is clear standing given Everi\u2019s operations in that jurisdiction.\u201d<\/p>\n

There is no time frame for when US District Judge Alan D. Albright may rule on Everi’s motion or Sightline’s complaint.<\/p>\n
