(Image: Getty)<\/figcaption><\/figure>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">American Kathryn Mayorga brought the civil case against the Portugal and Juventus player in 2018, claiming she was raped by him at his penthouse suite at the Palms Casino, Las Vegas in 2009. <\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">\u00a0<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\"><strong>In 2010 she accepted $375,000 to drop any accusations against the player but claims she was coerced into this and was mentally unfit when she took the hush money.<\/strong> <\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">\u00a0<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">Lawyers for Ronaldo sought to have <a href=\"https:\/\/www.casino.org\/news\/ronaldo-lawyers-file-motion-to-dismiss-palms-casino-rape-case\/\">the case dismissed<\/a> on the grounds that Mayorga was of sound mind when she agreed to the settlement and could not demonstrate she lacked mental capacity. <\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">\u00a0<\/span><\/p>\n<h2 class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><b><span style=\"color: black; letter-spacing: -.1pt;\">Trial by December<\/span><\/b><\/h2>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">\u00a0<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">But in court filings, Judge Jennifer Dorsey said, Mayorga provided written statements from both a psychiatrist and a therapist that said she did not have the legal ability to enter into a contract at\u00a0the time she signed the settlement agreement.<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"margin: 0cm; background: white;\"><span style=\"color: black; letter-spacing: -.1pt;\">\u00a0<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: black; letter-spacing: -.1pt;\">Mayorga also provided a written statement from a therapist who treated her shortly after the alleged assault. <\/span><\/p>\n<blockquote class=\"main-blockquote\">\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><strong><span style=\"color: black; letter-spacing: -.1pt;\">Because the proper venue for resolving Mayorga&#8217;s claims on their merits hinges on the mental-capacity issue, I deny without prejudice Ronaldo&#8217;s motion to dismiss them,\u201d<\/span><\/strong><span style=\"color: black; letter-spacing: -.1pt;\"> the judge said.<\/span><\/p>\n<\/blockquote>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: black; letter-spacing: -.1pt;\">Mayorga\u2019s lawsuit alleges <\/span><span style=\"color: #171616; background: white;\">battery, intentional infliction of emotional distress, coercion, fraud, and abuse of a vulnerable person.<\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: #171616; background: white;\">She claims that the NDA she signed was designed to derail a police investigation into a criminal act and wants it nullified. <\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: #171616; background: white;\">Mayorga initially reported the attack to police in 2009 but refused to identify a perpetrator because she feared negative publicity. <\/span><\/p>\n<h2 class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><b><span style=\"color: #171616; background: white;\">Football Leaks<\/span><\/b><\/h2>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: #171616; background: white;\">Las Vegas Metro Police reopened the case in 2018 when German news magazine<em> Der Spiegel<\/em> reported on the NDA, after receiving the 2010 documents from the <em>Football Leaks<\/em> website. The article prompted Mayorga to come forward and sue. <\/span><\/p>\n<div class=\"callout\">\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: #171616; background: white;\">According to documents filed last year, Ronaldo\u2019s people paid Mayorga the money \u201cin order to maintain the confidentiality of their dispute\u201d and was not an admission of guilt, as the NDA clearly stated that the player disputed the allegation. <\/span><\/p>\n<\/div>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><span style=\"color: #171616; background: white;\">Meanwhile, documents passed to <em>Der Spiegel<\/em> in October 2018 in which a person claiming to be Ronaldo appears to indicate that what happened at the Palms in 2009 was not consensual, and was \u201cstolen by hackers and falsified,\u201d according to Ronaldo\u2019s lawyer. <\/span><\/p>\n<p class=\"mol-para-with-font\" style=\"background: white; margin: 0cm 0cm 12.0pt 0cm;\"><strong><span style=\"color: #171616; background: white;\">Ronaldo himself has called the allegations \u201cfake news.\u201d<\/span><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A judge in Nevada has declined to dismiss a rape claim against soccer superstar Cristiano Ronaldo and ordered that a trial date be set by December.
